These terms are an agreement between you and Ankita Dubey ("Smasho", "we", "us") for using the Smasho app and website. By creating an account, booking a court as a guest, or otherwise using Smasho, you agree to them. Our Privacy Policy explains how we handle your data.
You can create your own account if you are 18 or older. Anyone under 18 uses Smasho through a profile that a parent or guardian, or their club, creates. If you create or manage a profile for a child, you agree to these terms on their behalf, confirm that you are their parent or guardian or a club acting with the parent's or guardian's consent, and are responsible for how the profile is used. You can book a court without an account if you are 18 or older; a signed-in player under 18 asks their parent or guardian to book.
Give accurate information, keep your password private, and tell us if you think someone else has accessed your account. You are responsible for activity on your account. You can delete it at any time in Settings › Delete Account.
We have zero tolerance for objectionable content and abusive users. You must not post or send anything that is:
You can report any post or reply and block any user from the post's options menu. We review reports within 24 hours, remove content that breaks these rules, and suspend or remove the accounts responsible. Content reported by several people is hidden automatically while we review it.
You own what you post. You give us permission to store, display and share it inside Smasho only as needed to run the features you use (for example, showing a shared journal entry to your coach). You can delete your posts at any time.
Clubs and coaches are independent from Smasho and are responsible for their lessons, schedules, facilities and prices. Smasho does not process payments. Payment records in the app are notes kept by clubs, parents and players; any payment happens directly between you and the club. Court bookings are covered in section 6.
A club or coach sees personal information about its players, parents and guests in Smasho. It may use that information only to run its own lessons, bookings and payments. It must keep it secure, must not sell it or use it for unrelated marketing, and must correct or delete it when the person asks or when it is no longer needed.
A club that adds a child to Smasho must first have the consent of the child's parent or guardian, and should use the parent's or guardian's email address for the child's profile.
Some clubs list their courts so that anyone can book one through Smasho, with or without an account.
If you are a club that lists its courts, you confirm that your hours, courts, prices, tax rate and payment details are accurate and kept up to date, and that you will honour bookings made through Smasho or tell the guest promptly if you cannot.
Workouts, drills and training suggestions in Smasho are general information, not medical advice. Check with a doctor before starting a new training program, stop if you feel pain, and train within your ability. You use training content at your own risk.
Don't misuse Smasho: no accessing other people's accounts or data, no interfering with the service, no reverse engineering except where the law allows, and no automated scraping.
You can stop using Smasho and delete your account at any time. We may suspend or end your access if you break these terms or put other users at risk.
Smasho is provided "as is". We work to keep it accurate and available but can't promise it will always be error-free or uninterrupted, or that a club's listed availability and prices are correct. To the extent the law allows, we are not liable for indirect or consequential losses, and our total liability to you is limited to the amount you paid us in the past 12 months (Smasho is currently free). Nothing in these terms limits rights you have under consumer law that can't be limited.
If you downloaded Smasho from the App Store, these terms are between you and Smasho, not Apple. Apple is not responsible for the app or its content, has no obligation to provide support or maintenance, and is not responsible for any claims relating to the app. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
If we change these terms in an important way, we will tell you in the app or by email before the change takes effect. Continuing to use Smasho after that means you accept the updated terms.
These terms are governed by the laws of Ontario, Canada.
